TERMS AND CONDITION

THE URBAN COLLAR PET SERVICES, LLC TERMS & CONDITIONS AGREEMENT

Effective Date: February 14th, 2025.This Terms & Conditions Agreement (the “Agreement”) is entered into by and between The Urban Collar Pet Services, LLC, a New Jersey limited liability company (“The Urban Collar,” “we,” “us,” or “our”), and the undersigned client or user of services (“Client,” “you,” or “your”). This Agreement governs your access to and use of grooming and related pet services (“Services”) provided by The Urban Collar through in-home, mobile, or studio appointments.BY BOOKING OR USING OUR SERVICES, YOU AFFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT.


1. DEFINITIONS

1.1. “Service Appointment” refers to any confirmed booking by you for pet grooming or related service.1.2. “No-Show” means a failure to make the pet available at the location within 10 minutes of the scheduled appointment time.1.3. “Deposit” means a partial payment made to secure a Service Appointment.


2. BOOKINGS, PAYMENTS & DEPOSITS

2.1. All Service Appointments must be secured via full payment or a minimum non-refundable deposit of thirty percent (30%) at the time of booking.2.2. The remaining balance, if any, is due before or at the time of service.2.3. Pricing is subject to variation depending on breed, coat condition, time, and location of service.2.4. Appointments are not guaranteed without a confirmed payment and email or SMS confirmation.


3. CANCELLATION & NO-SHOW POLICY

3.1. Clients may reschedule a Service Appointment with no penalty up to twenty-four (24) hours prior to the scheduled time.3.2. If a Client is unavailable or fails to provide access to the pet within ten (10) minutes of the appointment, it will be deemed a No-Show.3.3. All deposits and payments are non-refundable, including but not limited to cancellations, no-shows, or denied access.3.4. The Urban Collar may, at its sole discretion, apply such payment to a future appointment once, provided the rescheduling request is made within the permitted window.


4. REFUND POLICY

4.1. All sales are final. No refunds will be issued once a payment or deposit is received.4.2. In the event of inability to perform Services due to force majeure, The Urban Collar reserves the right to offer service credit or reschedule the appointment at no additional cost.4.3. Credit or reschedule determinations are made at the sole discretion of The Urban Collar and shall not be construed as a waiver of this Agreement.


5. CLIENT RESPONSIBILITIES

5.1. Client affirms that their pet is healthy, free of contagious conditions, and up-to-date on vaccinations.5.2. Client shall notify The Urban Collar of any known allergies, medical conditions, behavioral concerns, or injuries.5.3. Client must provide safe, legal, and convenient access to the property for mobile services, including necessary parking.5.4. The Urban Collar shall not be liable for services delayed or denied due to unsafe environments or failure to disclose pet risks.


6. SERVICE CONDITIONS & DISCRETIONARY REFUSAL

6.1. We reserve the right to refuse or cancel services at any time for any reason, including but not limited to unsafe or aggressive animals, health concerns, or environmental risks.6.2. Client agrees that matting, behavioral complications, or emergency care will be addressed at the groomer’s discretion and may incur additional fees.


7. PHOTOGRAPHY & MARKETING CONSENT

7.1. By using our Services, you grant The Urban Collar permission to photograph, video, and publish images of your pet for training, recordkeeping, or promotional purposes.7.2. If you wish to opt out of promotional usage, you must notify us in writing prior to your scheduled appointment.


8. LIMITATION OF LIABILITY

8.1. The Urban Collar is not responsible for any injury, reaction, stress, loss, or death resulting from grooming procedures when reasonable care and industry standards are followed.8.2. Client waives any right to seek damages, legal fees, or costs beyond the actual cost of services rendered.8.3. In no event shall The Urban Collar be liable for consequential, incidental, indirect, or special damages.


9. INDEMNIFICATION

Client agrees to indemnify, defend, and hold harmless The Urban Collar and its affiliates, agents, employees, contractors, and owners from and against all losses, damages, liabilities, costs, claims, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Breach of this Agreement;Failure to disclose pet medical or behavioral issues;Injury caused by the Client’s pet to any person or property.


10. GOVERNING LAW & DISPUTE RESOLUTION

10.1. This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflicts of law rules.10.2. Any dispute, controversy, or claim arising out of or relating to this Agreement or the breach thereof shall be submitted to binding arbitration in Essex County, New Jersey, in accordance with the Commercial Arbitration Rules of the American Arbitration Association.10.3. Judgment upon the award rendered may be entered in any court having jurisdiction.


11. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between you and The Urban Collar with respect to Services and supersedes all prior written or oral agreements. No modification shall be binding unless in writing and signed by both parties.


12. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.


13. ACKNOWLEDGEMENT

By booking a grooming appointment or using any of our services, you acknowledge that you have read, understood, and agreed to be legally bound by the above terms.
